The free flow of personal data between the EU and Japan

On 17 July 2018, the European Union (‘EU’) and Japan concluded negotiations for an Economic Partnership Agreement1 (‘the Agreement’). The signature of this Agreement represents a milestone for the two partners that together represent nearly a third of the world’s GDP. It is expected to create tremendous opportunities for business by removing tariffs and regulatory burdens. Simultaneously, the EU and Japan agreed to recognise each other’s data protection systems as equivalent and to adopt reciprocal adequacy decisions2. Such decisions will create the world’s largest area of safe data flows and will boost commercial opportunities for European and Japanese companies by facilitating the transfer of their data. Moreover, it will further expand the influence of the EU’s data protection standards on a global scale.
