India: The discussion around data privacy - the white paper

In India, awareness and concerns around data privacy and protection has gained momentum and its importance is now recognised globally. The Government of India issued, on 27 November 2017, a white paper to solicit public comments on various issues relating to data protection in order to develop a draft data protection bill (‘the White Paper’) and constituted a committee of experts under the chairmanship of former Supreme Court Justice Shri BN Srikrishna (‘the Expert Committee’). The Expert Committee was appointed to consider issues that require incorporation into law and to address responses received from public consultations, and is expected to release a draft bill soon. Supratim Chakraborty, Aritri Roy Chowdhury and Sneh Lata, Associate Partner and Associates respectively at Khaitan & Co LLP, analyse the development and the key principles of the White Paper.
