Canada: New rules for mandatory privacy breach notification

On 1 September 2017, the Canadian Government published proposed regulations relating to the mandatory reporting of privacy breaches under Canada’s federal data protection law, the Personal Information Protection and Electronic Documents Act 2000 (‘PIPEDA’) (‘the Draft Regulations’). The Regulations were open for public comment until 2 October 2017 and, after being finalised, are expected to come into force in early 2018. Alex Cameron and Claire Feltrin of Fasken Martineau DuMoulin examine the potential implications of the relevant provisions and the proposed regulations for organisations subject to PIPEDA.
