Commission proposes new measures for access to electronic evidence

In April 2018 the European Commission issued a ‘Proposal for a Regulation on European Production and Preservation Orders for electronic evidence in criminal matters’ (‘the Regulation’) which, if implemented in its current state, would inter alia provide authorities with the power to request judicial authorities in other Member States to directly request a service provider or its legal representative to disclose data about a user within six hours in ‘emergencies.’ In this article, Zoe Osborne, Chris Stott and Herbert Swaniker of Clifford Chance LLP provide their analysis of the proposed Regulation and what its implications could be for the security of information society services data held by online platforms.
